Nest31 ("we," "us," "our") operates the website nest31.com (the "Service"). Account Information: When you register through Clerk (our authentication provider), we collect your email address, display name, and a unique user identifier. You may also provide a username and select an avatar.

User-Generated Content: Posts, comments, replies, and any other content you submit to the community. This content is publicly visible to other users.

Usage Data: We automatically collect certain information including IP addresses, browser type, referring pages, pages visited, and timestamps.

AI Interactions: Messages sent through our AI assistant are processed by Anthropic's API. These messages may be temporarily stored for processing but are not used to build user profiles.

We use collected information to: operate and maintain the Service; display your content and profile within the community; send notifications about replies and interactions; enforce our Community Rules and Terms of Service; detect, prevent, and address fraud, abuse, or security issues; analyze usage patterns to improve the Service; and comply with legal obligations. We do not sell, rent, or trade your personal information to third parties for marketing purposes.

Service Providers: We use third-party services including Clerk (authentication), Anthropic (AI processing), Supabase (database hosting), and Vercel (web hosting). These providers have access to your information only as necessary to perform their services.

Legal Requirements: We may disclose your information if required to do so by law, court order, or governmental regulation.

Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

We use browser localStorage to store preferences such as your avatar, username, dark mode setting, and saved posts. This data resides on your device. Third-party services (Clerk) may use cookies for authentication and session management.

We implement commercially reasonable security measures including input sanitization, rate limiting, content filtering, and security headers to protect your information. However, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your data.

We retain your account information and content for as long as your account is active. You may request deletion of your account and associated data by contacting us. Upon account deletion, your profile information will be removed. Posts and comments may be anonymized rather than deleted to preserve community conversation integrity.

Nest31 is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information promptly.

Depending on your jurisdiction, you may have the right to: access the personal information we hold about you; request correction of inaccurate information; request deletion of your information; object to or restrict certain processing; and data portability. To exercise these rights, contact us. We will respond within 30 days.

If you are a California resident, you have the right to: know what personal information we collect; request deletion; opt out of sale (we do not sell personal information); and not be discriminated against for exercising your privacy rights.

Nest31 is a support community for parents of children on the autism spectrum. You agree to abide by our Community Rules. You agree NOT to: post abusive, threatening, harassing, or objectionable content; impersonate any person or entity; provide professional advice while falsely representing credentials; post spam or unauthorized promotional content; attempt unauthorized access to the Service; use automated scripts or bots; circumvent security features; or use the Service for any unlawful purpose.

You retain ownership of content you post. However, by posting, you grant Nest31 a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service. You warrant that your content does not infringe any third-party rights. We reserve the right to remove any content at our sole discretion.

THE NEST31 AI ASSISTANT IS NOT A MEDICAL PROFESSIONAL, THERAPIST, LAWYER, OR LICENSED PRACTITIONER OF ANY KIND. Information provided by the AI assistant is for informational and conversational purposes only. AI-generated responses may contain inaccuracies or errors. You must independently verify any information obtained through the AI assistant. Nest31 expressly disclaims all liability for actions taken based on AI-generated content.

NEST31 IS A PEER SUPPORT COMMUNITY, NOT A PROFESSIONAL SERVICE. Nothing on this platform constitutes medical advice, therapeutic guidance, legal counsel, or any other form of professional advice. Content posted by users reflects their personal experiences only. Always consult qualified, licensed professionals before making decisions about your child's care.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEST31, ITS OPERATORS, OWNERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE, ANY THIRD-PARTY CONTENT, AI-GENERATED CONTENT, OR UNAUTHORIZED ACCESS TO YOUR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED TEN DOLLARS ($10.00).

You agree to defend, indemnify, and hold harmless Nest31 and its operators, owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising from: your use of the Service; your violation of these Terms; your violation of any third-party right; any content you post; or any claim that your content caused damage to a third party.

The Service and its original content, features, and functionality are the exclusive property of Nest31 and its licensors, protected by copyright, trademark, and other laws.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason. Upon termination, your right to use the Service immediately ceases. Provisions that should survive termination shall survive.

Disputes shall first be attempted to be resolved through informal negotiation. These Terms are governed by the laws of the State of North Carolina. You agree to submit to the jurisdiction of courts in Mecklenburg County, North Carolina.

If any provision is held unenforceable, the remaining provisions continue in full force and effect.

These Terms, our Privacy Policy, and Community Rules constitute the entire agreement between you and Nest31 regarding the Service.
